Terms and Conditions

1. Payment Terms

Payments are due after you approve the free website draft and before Huddy Digital begins work on your full website. Once payment is made and the first official draft is created, all sales become final with no refunds provided.

2. Revisions After Launch

One round of designer-approved changes is included after your site goes live. Additional updates, new pages, or scope beyond that round are quoted individually before work begins.

3. Hosting Payment Terms

Clients declining monthly domain and hosting services must pay a $200 one-time website transfer fee to cover Huddy Digital's costs for launch and ownership transfer.

4. Ownership and Copyright

Upon receipt of final payment, the client will own the rights to the website design, layout, and content, excluding any third-party software, plugins, fonts, or licensed materials. Designers may display completed projects in portfolios and marketing materials unless written agreements state otherwise.

5. Client Responsibilities

Clients must provide all required materials promptly and ensure all provided content complies with copyright laws without infringing third-party rights.

6. Revisions and Changes

Additional fees apply for revisions beyond the agreed scope or after final approval.

7. Project Timeline

An estimated project timeline will be provided at the beginning of the project. Client delays in delivering content or approvals may extend timelines accordingly.

8. Confidentiality

Both parties maintain confidentiality regarding proprietary, sensitive, or non-public information shared during the project.

9. Termination of Agreement

Either party may terminate if the other breaches terms and fails to remedy within a reasonable timeframe. Clients must pay for all completed work through the termination date.

10. Liability and Indemnity

The designer bears no liability for website functionality issues, security vulnerabilities, or third-party service problems. Clients indemnify the designer from claims arising from website use.

11. Force Majeure

Neither party will be held liable for delays or failure to perform due to circumstances beyond their control, including natural disasters, acts of war, pandemics, or system outages.

12. Amendments to Terms

The designer reserves the right to update or modify these terms at any time. Continued service use constitutes acceptance of updates.

13. Dispute Resolution

Parties must attempt mediation first. If mediation is unsuccessful, the dispute will be governed by and resolved in accordance with the laws of the Province of Nova Scotia.
